The purpose of the Administrative Memorandum (ADM) is to set forth requirements and guidelines for occupancy agreements that are mandated under federal regulations for OPWDD-certified residential settings funded through OPWDD’s Comprehensive Home and Community-Based Services (“HCBS”) Waiver as authorized under section 1915(c) of the federal Social Security Act. OPWDD is not requiring that providers utilize a specific document but has appended a template occupancy agreement to this ADM as a convenience for providers to use as a possible model for their own agreements.
